As required by Section 32-1-207(3)(c), C.R.S. and Section VIII of the Amended and Restated Consolidated Service Plan for Murphy Creek Metropolitan District Nos. 1-4 and Service Plan for Murphy Creek Metropolitan District No. 5 (collectively, the “Districts”), approved by the City of Aurora (the “City”) on August 8, 2016, the following report of the activities of Murphy Creek Metropolitan District No. 1 (the “District”) from January 1, 2025 to December 31, 2025 (the “Report Year”) is hereby submitted.
A. Boundary changes made or proposed to the District’s boundaries as of December 31 of the prior year:
The District’s boundaries did not change in 2025.
B. Intergovernmental Agreements entered into or terminated:
The District has entered into or terminated the following agreements:
i. Intergovernmental Agreement Regarding Payment of Reimbursements for Capital Expenses by and between Murphy Creek Metropolitan District No. 1 and Murphy Creek Metropolitan District No. 2, dated October 2, 2024. This agreement was subsequently amended by virtue of the First Amendment to Intergovernmental Agreement Regarding Payment of Reimbursements for Capital Expenses by and between Murphy Creek Metropolitan District No. 1 and Murphy Creek Metropolitan District No. 2, dated November 13, 2024.
ii. Aurora Regional Improvement Authority No. 5 Second Amendment to Establishment Agreement, dated November 15, 2018. The Districts are parties to all subsequent amendments.
iii. District Administrative Services Agreement between Murphy Creek Metropolitan District Nos. 1, 2, 4 and 5, dated April 26, 2017. The District Administrative Services Agreement was partially terminated by such Partial Terminations dated as of August 26, 2021 and April 5, 2022. The agreement was subsequently amended and restated by virtue of the Amended and Restated District Maintenance and Administrative Services Agreement, dated as of November 9, 2022. This agreement was fully terminated pursuant to the Termination of Amended and Restated District Maintenance and Administrative Services Agreement by and between the District and Murphy Creek Metropolitan District No. 2 dated November 12, 2025.
iv. Intergovernmental Agreement between the City and the Murphy Creek Metropolitan District Nos. 1, 2, 3 and 4, dated February 3, 1999. This agreement was subsequently amended by virtue of the Amended and Restated Intergovernmental Agreement between the City and the Murphy Creek Metropolitan District Nos. 1, 2, 3, 4 and 5, dated August 8, 2016.
v. District Facilities Construction and Service Agreement between the Murphy Creek Metropolitan District Nos. 1, 2, 3 and 4, dated December 1, 2000. This agreement was subsequently amended by virtue of the First Amendment to the District Facilities Construction and Service Agreement between the Murphy Creek Metropolitan District Nos. 1, 2, 3 and 4 and the Second Amendment to the District Facilities Construction and Service Agreement, dated February 13, 2006.
C. Access information to obtain a copy of rules and regulations adopted:
The District did not adopt any rules or regulation during the Report Year. D. Summary of litigation involving the District’s public improvements:
To our knowledge, there is no litigation involving the District’s public improvements.
E. Status of the District’s construction of public improvements:
Construction of the District’s public improvements has begun in accordance with the Service Plan.
F. A list of facilities and improvements construction by the District that have been dedicated to and accepted by the City as of December 31 of the prior year:
As of December 31, 2025, the District had not constructed or acquired any facilities or improvements that were conveyed or dedicated to the City.
G. Final assessed valuation of the District for the Report Year:
$7,733.
H. Current year’s budget including a description of the Public Improvements to be constructed in such year:

To our knowledge, there are no uncured events of default by the District which continue beyond a ninety (90) day period.

To our knowledge, the District has been able to pay its obligations as they come due.
